"ファイル共有ソフトWinnyを自己のホームページ上で公開し、それをダウンロードした者が犯した著作権法違反を幇助した罪に問われて開発者が起訴された事件は、一審の京都地裁では有罪、二審の大阪高裁では逆転無罪となり、司法判断に大きな違いが生じ、検察の逮捕や司法判断の妥当性をめぐって社会的関心を広く集めて盛んに論じられている。Winnyの事件には、ソフトウェアの技術開発者に著作権法（公衆送信権）違反の幇助罪を適用したことが、司法判断として妥当かという法的解釈にとどまらず、インターネットの発展した世界でのデジタルコンテンツの著作権のあり方や、技術開発者が負うべき責任の範囲や判断について重要な問題が含まれている。本論では、一審と二審判決について検討し、アメリカのMITの学生は通信詐欺で起訴されたラマッキア事件と対比し、新しい技術開発における技術者が負う倫理的責任のガイドライン設定の問題を考察する。",
